Not every marriage that goes wrong ends in divorce. Some marriages are void, which means they are treated in law as if they never happened. Others are voidable, which means they are valid until a court annuls them. Annulment is different from divorce: divorce ends a valid marriage, while annulment declares that the marriage was never valid or sets it aside. This explainer sets out when a marriage is void and when it is voidable, the grounds, and the effect. Last verified October 2026.

The short answer
  • Void marriage: a nullity from the start under Section 11 of the Hindu Marriage Act, for example bigamy, a prohibited degree, or a sapinda relationship.
  • Voidable marriage: valid until annulled by a decree of nullity under Section 12, on grounds such as impotence, lack of consent, force, fraud, or concealed pregnancy by another.
  • Annulment vs divorce: annulment declares the marriage void or sets it aside as if it was never valid, while divorce ends a valid marriage.
  • Children: children of a void or voidable marriage are treated as legitimate under Section 16.

01Void, voidable and divorce

There are three different ideas here. A void marriage is a nullity from the start, so in law it never existed. A voidable marriage is valid and subsisting until a court annuls it on the petition of one spouse. Divorce, by contrast, dissolves a marriage that was always valid.

Under Hindu law, void marriages are dealt with in Section 11 of the Hindu Marriage Act, 1955 and voidable marriages in Section 12. Annulment, whether of a void or a voidable marriage, is obtained by a decree of nullity from the court.

Divorce says the marriage has ended. Annulment says the marriage was never valid, or can be set aside as if it had not been.

02When a marriage is void

A marriage is void under Section 11 of the Hindu Marriage Act if it breaks certain basic conditions of a valid marriage in Section 5. These are:

  • Bigamy: either party already has a living spouse at the time of the marriage (Section 5(i)).
  • Prohibited degrees: the parties are within the degrees of relationship the law prohibits, unless a custom allows it (Section 5(iv)).
  • Sapinda relationship: the parties are sapindas of each other, unless a custom allows it (Section 5(v)).

A void marriage is a nullity whether or not a court says so. A party can still seek a decree of nullity to have the position recorded, but the marriage was never valid.

03When a marriage is voidable

A marriage is voidable under Section 12 of the Hindu Marriage Act when a defect allows one spouse to have it set aside. The grounds include:

  • Non-consummation due to impotence: the marriage has not been consummated because of the impotence of the respondent.
  • Incapacity to consent or mental disorder: consent was affected by, or the party suffers from, a condition within Section 5(ii), such as unsoundness of mind.
  • Consent by force or fraud: the consent of the petitioner was obtained by force or by fraud.
  • Pre-marriage pregnancy by another: the respondent was pregnant by someone other than the petitioner at the time of marriage.

A voidable marriage stays valid until the court annuls it. Until a decree of nullity is passed, the marriage subsists and has all the normal effects.

04The key differences

PointVoid marriage (s.11)Voidable marriage (s.12)
StatusNullity from the startValid until annulled
Needs a decreeNot to be void, but a decree can be soughtYes, a decree of nullity is needed
Who can act on itTreated as never existingOnly the aggrieved spouse can seek annulment
Typical groundsBigamy, prohibited degrees, sapindaImpotence, lack of consent, force, fraud, concealed pregnancy

In short, a void marriage is void on its own, while a voidable marriage is valid unless and until the aggrieved spouse goes to court and obtains a decree of nullity.

05Time limits for a voidable marriage

For a voidable marriage, timing matters. For some grounds, such as fraud or force and concealed pregnancy, the petition for nullity must be filed within a limited time, often one year, and other conditions apply, such as no marital intercourse after the petitioner learned the facts.

Because these limits can defeat an otherwise good ground, a spouse who wants an annulment of a voidable marriage should act promptly and check the exact conditions in Section 12 before filing.

06What happens to the children

A common worry is the status of children. The law protects them. Under Section 16 of the Hindu Marriage Act, children of a marriage that is void or voidable are treated as legitimate, even though the marriage itself is annulled or declared void.

So the children keep their legitimacy, and their rights, such as to maintenance, are not lost because the marriage of their parents was void or set aside.

07The forum and procedure

  1. File the petition: file a petition for a decree of nullity in the Family Court or District Court that has jurisdiction.
  2. State the ground: set out whether the marriage is void (Section 11) or voidable (Section 12) and the exact ground.
  3. Notice and evidence: the court issues notice to the other spouse and hears the evidence on the ground pleaded.
  4. Decree: if the ground is made out, the court passes a decree of nullity.

If the marriage was valid but the couple simply wants to end or pause it, the routes are divorce or judicial separation instead. For a civil or interfaith marriage, the conditions of a valid marriage and the registration are set out in the Special Marriage Act procedure.

10Frequently asked questions

What is the difference between a void and a voidable marriage?

What makes a marriage void?

Under Section 11 of the Hindu Marriage Act, a marriage is void if it is bigamous, if the parties are within the prohibited degrees of relationship, or if they are sapindas of each other, unless a valid custom permits the marriage.

Yes. Claw keeps track of the cases, orders and hearings in an annulment matter across 9,102 courts, benches and forums, and lets you search more than 30 crore judgments for how the void and voidable grounds have been decided, returning results in under 5 seconds. It researches and tracks the case; it does not give legal advice.
