How to find your trademark renewal due date, check renewal status on IP India, and what to do if the deadline has passed. Last verified October 2026.
How-to Guide · Trademark Renewal
A trademark registration in India lasts 10 years and must be renewed every 10 years, and the cost of missing that date is a mark that can be removed from the register. This guide shows how to work out your renewal due date, how to check renewal status on the IP India website, what the six month surcharge window means, and how restoration works if the mark has already lapsed. Claw can also track renewal deadlines for you with alerts, covered near the end.

01Why trademark renewal dates get missed
Trademark renewal is missed because the date is ten years away from the day you filed, and almost nobody is watching it. The mark may have been filed by an earlier agent, a former employee or a founder who has since moved on.
The date is easy to lose
A registration is valid for 10 years from the date of application, not from the date the certificate reached you. Many owners remember the certificate date and count from there, which gives the wrong year. Over a decade, email addresses change and the original file is forgotten.
The cost of a miss is real
If renewal is not filed in time, the Registrar can remove the mark from the register. A removed mark is harder to enforce, and a rival may apply for something close to it. The fix is possible, but it costs more and takes more steps than renewing on time.
Portfolios make it worse
A company with many marks in many classes has many different due dates. A single missed class can leave a gap in protection for that class only.
A registration lasts 10 years. The real risk is not the renewal fee, it is not knowing the date until it is gone.
02The renewal timeline at a glance
The Trade Marks Act, 1999 sets a 10 year term, and renewal is filed on Form TM-R under Section 25 and the Trade Marks Rules, 2017. The table below shows the key windows. Fees are government fees per class and can change, so confirm them on the IP India fee schedule before filing.
| Stage | When | What you do | Form |
|---|---|---|---|
| Normal renewal | Up to one year before expiry, and not later than the expiry date | File renewal with the fee for each class | TM-R |
| Renewal with surcharge | Within six months after expiry | File renewal with the renewal fee plus the surcharge | TM-R |
| Restoration and renewal | After removal from the register, within the period the Act allows (generally up to one year after expiry) | Apply to restore the mark and renew it, with the higher fee | TM-R |
| Beyond that | After the restoration window closes | A fresh application may be needed, and prior rights may be affected | TM-A |
Renewal is filed per class. If your registration covers several classes, each one needs its own fee. You can renew some classes and let others go, but that choice should be deliberate.
The Registrar also sends a notice before expiry. Do not rely on it, because it goes to the address of record, which may be outdated.
03How to check trademark renewal status on IP India
You can check the renewal due date and status for free on the official IP India public search, using the application number. Here is the full process.
- Get the application number. It is on the filing receipt and the registration certificate. If you do not have it, search by the mark name or by the owner name.
- Open the public search. Go to the IP India Trade Mark Public Search page (tmrsearch.ipindia.gov.in) and pick the search type that fits what you have.
- Search and open the record. Enter the number, complete the captcha, and open the matching entry.
- Read the key fields. Look at the date of application, the registration date, the class, the current status and any renewal entries.
- Work out the due date. Add 10 years to the date of application, then to the last renewal date. That is your next deadline.
- File TM-R if due. Renewal is filed online through the IP India e-filing portal, with the fee per class.
- Save the receipt and re-check. After filing, check the record again later to confirm the renewal has been entered.
Need a full status check?
This guide is about renewal. For how to read objections, hearings and the wider status of an application or registration, see our guide to checking trademark status in India.
04Reading the status you see
The status field tells you whether the mark is alive, due, or already removed. The exact labels on the portal can change, so treat the list below as a guide.
- Registered: the mark is on the register. Check the date and compute the next renewal date.
- Registered and renewed: renewal has been recorded. Note the new expiry date.
- Removed or expired: the mark has come off the register for non-renewal. Look at the restoration route below.
- Other statuses: objected, opposed or abandoned entries are about the application, not renewal.
If the status and your records do not match, do not assume your copy is right. The register is the official record. A registered mark can also have a pending renewal that has not yet been updated, so keep your filing receipt.
05What to do if the renewal date has passed
If the date has passed, act fast, because the options narrow each month. Your route depends on how long ago the mark expired.
Within six months after expiry
You can still file renewal on Form TM-R, but you must pay the surcharge on top of the renewal fee for each class. This is the cheapest late option.
After removal from the register
If the mark has been removed, you can ask for restoration and renewal on Form TM-R, with the higher fee. The Act sets a limit on how long after expiry this can be done, so check the dates now rather than later. Restoration is not automatic and the Registrar can ask for reasons.
When the window has closed
You may have to file a new application. Check that nobody else has filed a similar mark in the meantime, and get an advocate or trademark attorney to advise on your rights from past use.
For complex cases, such as a mark that was removed while in use or under dispute, speak to a trademark professional. This guide is general information and not legal advice.
06Where Claw fits
Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
For trademark renewal, the useful part is deadline tracking. Claw’s case management has a calendar and WhatsApp and email alerts, so a renewal date can be entered once and flagged well before it falls due. This is useful for advocates and in-house teams who look after many marks for many clients. Claw does not replace the IP India portal, since the actual renewal is still filed there. If a renewal turns into a dispute, you can also read about checking a business partner for litigation or compare tools in our guide to the best legal case management apps in India. Claw has a free plan for individual advocates, and paid plans for teams.
