Tracking Plant-Variety IP Appeals in the Delhi IPD
A step-by-step way to find and follow plant-variety appeals in the Delhi High Court IP Division (IPD), using the case-type code C.A.(COMM.IPD-PV), with the official sources to check each step. Last verified October 2026.
How-To · Plant Variety Appeals
Plant-variety appeals are rare, and they are easy to lose in a court system built around trademarks and patents. If you are looking for a PPVFR appeal in Delhi, you will not find it by searching a party name on a general portal and hoping. The one code that matters is C.A.(COMM.IPD-PV), the case type the Delhi High Court IP Division uses for appeals under section 56 of the Protection of Plant Varieties and Farmers’ Rights Act, 2001. This guide shows how to use it. Last verified October 2026.
- The code: plant-variety appeals in the Delhi High Court IP Division are filed as C.A.(COMM.IPD-PV).
- The law: they arise under section 56 of the PPV&FR Act, 2001.
- Method: get the Authority order, search by case type and year, then match by party and date.
- Verify: check codes and rules on the Delhi High Court website. Last verified October 2026.
01Why plant-variety appeals are hard to find
A plant-variety appeal is hard to find because very few are filed, and the case type is easy to miss. There is no large public feed of them, so a search that works for a trademark appeal often returns nothing here.
The old forum is gone
Appeals from the Protection of Plant Varieties and Farmers’ Rights Authority once went to the IPAB. After the Tribunals Reforms Act, 2021, the IPAB was wound up and such appeals moved to the High Court. In Delhi, they are heard by the Intellectual Property Division. Older articles and older case lists still point to the IPAB, which sends people to the wrong place. For the wider picture of where each IP appeal goes now, see where IP appeals go after the IPAB.
The dispute is not in the names you expect
Many of these matters involve a seed company, a farmer group or a breeder on one side, and the Authority or its Registrar on the other. Parties are often written in different ways across orders. Searching by a single spelling can miss the case.
The case type is the real key
The Delhi High Court IP Division files each kind of IP matter under its own case-type code. If you know the code, you can narrow thousands of IP matters to the few you want.
One fact to hold on to
In the Delhi High Court IP Division, appeals under section 56 of the PPV&FR Act are filed as C.A.(COMM.IPD-PV). Search by that code first, then by party name.
02The one code: C.A.(COMM.IPD-PV)
C.A.(COMM.IPD-PV) is the case-type code for a civil appeal in the IP Division under the plant variety law. It is built from short parts, and each part tells you something.
- C.A.: civil appeal.
- COMM: the matter sits in the commercial side of the court.
- IPD: the Intellectual Property Division of the Delhi High Court.
- PV: plant varieties.
Section 56 of the PPV&FR Act, 2001 is the appeal provision. It allows an appeal to the High Court against certain orders or decisions of the Authority or the Registrar. These include decisions on registration of a variety, on registration of an agent or licensee, on benefit-sharing claims, and on compulsory licences or compensation.
The Delhi High Court IP Division Rules, 2022 set out how these matters are named and listed. Read the rules themselves on the court’s website to confirm the current wording of the code.
To find a plant-variety appeal in Delhi, start with the case-type code C.A.(COMM.IPD-PV), and read it with section 56 of the PPV&FR Act.
03Step-by-step: how to find an appeal
You can find a plant-variety appeal in five steps. Do them in this order, because each step narrows the one before it.
Step 1: Write down what you already know
Note the name of the variety, the applicant or breeder, the registration or application number, and the date of the Authority’s order. Even one of these helps.
Step 2: Get the order that is being appealed
The appeal always follows an order of the Authority or the Registrar. Look for that order on the official Plant Authority website. The order tells you the party names exactly as the court will write them.
Step 3: Search the Delhi High Court by case type
On the court’s case-status service, choose the case type for C.A.(COMM.IPD-PV) and the year. You will get the list of such appeals for that year. The list is short, so you can read every entry.
Step 4: Match by party name and order date
Check each entry against the party names and order date from Step 2. Try spelling variants and the short form of company names. If the appeal is recent, it may not appear for a few days after filing.
Step 5: Confirm with the order itself
Once you find a likely match, open the order or cause-list entry. Confirm that it names the same variety and the same Authority order. Then note the full case number, for example C.A.(COMM.IPD-PV) number and year, so you can follow it.
If you find nothing
First, check the year. Second, check that the appeal was not filed under a different IPD code by mistake. Third, check whether the matter is a writ or a suit instead of a section 56 appeal. Different routes have different codes.
04Following the appeal after you find it
Finding the appeal is half the job. Following it means watching hearings, orders and the next date.
- Hearing dates: check the daily cause list of the IP Division for the case number. IPD matters are listed before the judge assigned to IP matters.
- Orders: download each order and save it with the case number in the file name.
- Related matters: the same variety may also have an opposition before the Authority, or a related suit. Keep these linked in one place.
- Final judgment: when decided, the judgment is often available on the court website and on Indian Kanoon. Check it against the order on the court site.
Doing this by hand works for one or two appeals. If you follow many IP matters across courts, it becomes a daily chore, which is when a tracking tool is worth considering. 05Where to check official sources
Every step above can be checked against a primary source. This is the safest way to avoid errors.
| What to check | Primary source | Note |
|---|---|---|
| Text of section 56 and the Act | India Code (indiacode.nic.in) | Official text of the PPV&FR Act, 2001 |
