Format · Property Drafting
A rent agreement is the written contract between a landlord and a tenant that sets out the rent, the deposit, the period and the rules for using the property. Most rent agreements in India are made for eleven months, and there is a legal reason for this: a lease for a term of one year or more must be registered, while a lease for less than one year need not be. An eleven-month agreement avoids compulsory registration and keeps stamp duty low, which is why it is so common. This page explains the eleven-month versus registered lease rule, the stamp duty, the clauses that matter, a usable format, and the deposit and eviction disputes that follow. Last verified October 2026.
- Why 11 months: a lease of one year or more must be registered, while a lease under one year need not be, so an 11-month agreement avoids registration and keeps stamp duty low.
- Registration: compulsory for a lease year to year or exceeding one year under Section 17(1)(d) of the Registration Act, 1908.
- Stamp duty: set by each state, usually small for a short residential tenancy; confirm your state rate.
- Watch the clauses: rent, deposit refund, notice, lock-in, maintenance and permitted use cause most disputes.
01What a rent agreement is
A lease, in law, is the transfer of the right to enjoy a property for a period in return for rent. It is defined by Section 105 of the Transfer of Property Act, 1882. A rent agreement is the written form of that lease for a home, a shop or an office. It records who the landlord and tenant are, the property, the rent and the deposit, how long the tenancy runs, and what each side may and may not do.
A clear rent agreement is not just paperwork. It is the document both sides rely on if there is a fight over the deposit, repairs, rent increase or vacating. For a commercial property, the terms are more detailed; see the commercial lease agreement format.
02Why 11 months, and when a lease must be registered
The eleven-month habit comes straight from the registration law:
- Under Section 17(1)(d) of the Registration Act, 1908, read with Section 107 of the Transfer of Property Act, a lease of immovable property from year to year, or for a term exceeding one year, or reserving a yearly rent, must be registered.
- Under Section 18(c), a lease for a term less than one year need not be registered; registration is optional.
So an eleven-month agreement falls just below the one-year line, which means it need not be registered and attracts lower stamp duty. That is the only real reason it is so popular. It is still a valid, enforceable contract.
A long tenancy should be a registered lease
If you actually want a longer, more secure arrangement, say three or five years, the safe course is a registered lease deed, not a string of eleven-month renewals. An unregistered lease for a year or more does not create the full tenancy and cannot be used to prove its terms in court. Some states also run a tenancy registration system under the Model Tenancy Act, 2021, which several states have adopted; check whether your state requires the tenancy to be registered with the rent authority.
Where there is no written lease, the law treats a tenancy with monthly rent as a month-to-month tenancy under Section 106, which either side can end with proper notice.
03Stamp duty on a rent agreement
Stamp duty on a rent agreement is set by each state and is usually small for a short residential tenancy, often worked out on the rent and deposit and the length of the agreement. Many states let you pay it through e-stamping. A registered lease for a longer term attracts higher stamp duty, which is another reason the eleven-month agreement is used for short tenancies.
Confirm the current rate for your state and pay it before signing. For how stamping works on contracts generally, see stamp duty on agreements, and for the online route, how e-stamping works in India.
04Clauses that matter
A good rent agreement is clear on the points that usually cause trouble later:
- Rent and due date: the monthly amount, when it is payable, and the mode of payment.
- Security deposit: how much, and exactly when and how it will be refunded when the tenant leaves.
- Period and renewal: the term, and how it will be renewed or increased, for example an agreed annual rent rise.
- Notice to vacate: how much notice each side must give to end the tenancy.
- Maintenance and repairs: who pays for what, and who bears society charges and utility bills.
- Use and sub-letting: the permitted use, and whether the tenant may sub-let or share.
- Lock-in period: any minimum period during which neither side can walk out.
05A usable rent agreement format
Below is a general eleven-month residential rent agreement format you can adapt. Change the names, property, amounts and terms to your case, pay the stamp duty for your state, and have it signed by both parties and two witnesses.
RENT AGREEMENT This Rent Agreement is made on this ____ day of __________ 20____ BETWEEN [Full name], resident of ____________________ (the LANDLORD); AND [Full name], resident of ____________________ (the TENANT). The Landlord agrees to let, and the Tenant to take on rent, the premises at ____________________ (the Premises), on these terms: 1. TERM: 11 months from __________ to __________, renewable by mutual agreement. 2. RENT: Rs __________ per month, payable in advance by the ____ day of each month, by [mode]. 3. SECURITY DEPOSIT: Rs __________, paid by the Tenant, refundable within ____ days of vacating, after deducting unpaid rent and the cost of any damage beyond normal wear and tear. 4. USE: the Premises shall be used only for [residential] purpose and shall not be sub-let without the Landlord's written consent. 5. MAINTENANCE AND BILLS: the Tenant shall pay electricity, water and [society/maintenance] charges; the Landlord shall bear [structural repairs / property tax]. 6. NOTICE: either party may end this agreement by giving ____ [one/two] month(s) written notice. Lock-in period: ____ months. 7. RENT INCREASE: on renewal the rent may be increased by ____% per year. 8. HANDOVER: on ending the tenancy the Tenant shall hand back the Premises in good condition, with all keys. IN WITNESS WHEREOF the parties have signed this Agreement on the date first written above. ________________ ________________ LANDLORD TENANT WITNESSES: 1. Name, signature __________ 2. Name, signature __________
Keep a stamped, signed copy with each party. If the term is a year or more, register the agreement as a lease deed instead.
06Deposit and eviction disputes
Two disputes come up again and again. The first is the security deposit: a landlord who delays or refuses to refund it, or deducts too much. A clear refund clause, a move-in and move-out condition note, and proof of payment all help. See how to recover your security deposit.
The second is eviction: a tenant who stops paying or will not leave, or a landlord who tries to throw a tenant out without due process. A landlord cannot evict by force; the right way is a proper notice and, if needed, a case before the rent or civil court. See the eviction notice format and how to evict a tenant who is not paying rent.

09Frequently asked questions
Why are rent agreements usually for 11 months?
Because a lease for a term of one year or more must be registered under Section 17(1)(d) of the Registration Act, while a lease for less than one year need not be. An 11-month agreement stays just below the one-year line, so it avoids compulsory registration and attracts lower stamp duty.
Is a rent agreement valid without registration?
An 11-month agreement is valid and enforceable without registration. But a lease for a term of one year or more must be registered; if it is not, it does not create the full tenancy and cannot be used in court to prove its terms.
How much stamp duty is payable on a rent agreement?
It depends on the state and is usually small for a short residential tenancy, worked out on the rent, deposit and period. Many states allow e-stamping. Check the current rate for your state and pay it before signing.
What should a rent agreement contain?
The rent and due date, the security deposit and how it is refunded, the term and renewal, the notice to vacate, who pays for maintenance and bills, the permitted use and sub-letting rules, and any lock-in period.
Can a landlord evict a tenant without notice?
No. A landlord cannot evict by force or without due process. The right way is to give proper notice and, if the tenant does not leave or pay, file a case before the rent or civil court. The notice period and grounds should match the agreement and the local rent law.
When should I register the tenancy instead of using an 11-month agreement?
When you want a longer, more secure term such as three or five years. A registered lease deed protects both sides for the full period, whereas repeated 11-month renewals give less security. Some states also require the tenancy to be registered with a rent authority under the Model Tenancy Act.
