Section 12 of the POCSO Act, 2012 sets the punishment for sexual harassment of a child, which the law defines in Section 11. The punishment is imprisonment of either description for a term which may extend to three years, and a fine. Sexual harassment here does not need physical contact. It covers acts done with sexual intent, such as certain words, gestures, showing objects or body parts, following or watching a child, or enticing a child for pornography. This page explains what Section 12 says, how it works with Section 11, the key case law, and the procedure. Last verified October 2026.

The short answer
  • What it is: Section 12 sets the punishment for sexual harassment of a child, defined in Section 11.
  • Punishment: imprisonment of either description up to 3 years, and fine, with no fixed minimum.
  • What it covers: sexual words, gestures, showing body parts, stalking or watching, threats, and enticing a child for pornography, with no physical contact needed.
  • Graver forms: touching moves the case to Section 8, and penetration to Sections 4 or 6.

01The short answer

Section 12 is the punishment section for sexual harassment of a child, which is any person below 18 years. The offence itself is defined in Section 11. Section 12 provides imprisonment of either description for a term which may extend to three years, and a fine.

Unlike the other POCSO punishment sections, Section 12 sets no minimum. It fixes only a ceiling of three years, so the court has a wide range down to a short term, with a fine.

02What Section 11 defines

Section 12 does not describe the act. The act is defined in Section 11, which covers sexual harassment of a child. A person commits it if, with sexual intent, they:

  • say words or make a sound or gesture, or show an object or body part, meant to be seen or heard by the child;
  • make the child show their body, or follow or watch or contact the child repeatedly, in person or online;
  • threaten to use a real or fabricated image of the child in a sexual way; or
  • entice a child for pornographic purposes.

No touching needed

Sexual harassment under POCSO does not require physical contact. The focus is on the sexual intent behind the words, gestures, watching, or enticement.

03What Section 12 punishes

The punishment under Section 12 is a ceiling, not a range with a floor.

ElementSection 12
Minimum imprisonmentNo fixed minimum
Maximum imprisonmentThree years
Type of imprisonmentEither description, simple or rigorous
FineYes, in addition to imprisonment

Because there is no minimum, the court has room to fit the sentence to the facts, which range from a one-off remark to a sustained course of stalking or online harassment.

04How it fits with the other offences

Section 12 sits at the lower end of the POCSO ladder, because it covers conduct without physical contact. Where there is touching with sexual intent, the offence moves up to sexual assault under Section 8. Where there is penetration, it moves up again to Section 4 or, in aggravated cases, Section 6.

Harassment that uses a child for pornography can also attract the separate offences dealing with child pornography, which carry heavier punishment.

05How a Section 12 case runs

A Section 12 offence is cognizable and tried by a designated Special Court on the child-friendly track. The usual POCSO safeguards apply.

Under Section 29, once the prosecution proves the foundational facts, the Special Court presumes the accused committed the offence unless the contrary is shown. Under Section 33, the court follows a protective procedure for the child. For the wider walk-through, see how a POCSO case is tried, and for release pending trial see bail under the POCSO Act.

06Key case law

High Courts have applied Section 12 to online and repeated contact, including persistent messaging and stalking of a minor, holding that no physical contact is needed. Courts have also read the sexual intent requirement carefully, so that an isolated act without such intent does not become an offence.

Because the offence is wide and the punishment flexible, outcomes depend closely on the facts and the proof of sexual intent.
