No Instigation, No Abetment: The Man Accompanying Her Is Discharged
A man was charged with abetting a young woman's suicide after she jumped into a canal while travelling with him. The Uttarakhand High Court has quashed the charge and discharged him.
The Court held the charge under Section 306 IPC was not based on any material and was outside the evidence. Eyewitnesses said she suddenly jumped, and even the complainant said there was no content of instigation. Applying Supreme Court rulings on abetment, the charge was quashed and he was discharged.
- Abetment needs instigation. Suspicion or presence alone is not enough.
- The complainant's own statement admitted no instigation.
- Eyewitnesses described a sudden act, not pressure by the accused.
- A charge must rest on material; this one did not.

What happened
In September 2021 a young woman travelled towards Rishikesh for an examination. Her mother said the woman had told her the applicant, known to the family, would take her there by motorcycle.
Later that evening the mother received calls that the pair had been stopped near a dam, and then that her daughter had fallen into the canal. The mother suspected he had done something to drive her to jump, and an FIR was lodged for abetment of suicide.
A charge-sheet was filed, and in February 2022 the Sessions Judge framed a charge under Section 306.
Why the charge was quashed
In her statement to the police, the mother did not allege instigation, and when asked, said there was no content of instigation for suicide. Two eyewitnesses said the deceased suddenly jumped into the canal.
Considering Sections 306 and 107 of the IPC and the Supreme Court's rulings on abetment of suicide, the Court held the charge was not based on any material and was outside the evidence on record.
The result
The order framing the charge and the charge itself were quashed, and the applicant was discharged.
Who argued it
Appearances as recorded in the judgment of the Court.
Frequently asked
What must be shown for abetment of suicide?
Some instigation, provocation or intentional aid. Mere presence or suspicion is not enough.
Can a charge be quashed before trial?
Yes, where it rests on no material, as here.
Challenging an abetment-of-suicide charge
- Look for any specific act of instigation, provocation or aid in the record.
- Read the complainant's statements for admissions.
- Rely on eyewitness accounts of the incident itself.
- Seek discharge at the charge stage if the material is absent.
